Workers Compensation During the Coronavirus (COVID-19) Epidemic

Throughout the coronavirus epidemic, I am seeing Walmart, Target, Dollar Tree, Amazon, and many other grocery stores hiring, which frighten me. I also see companies such as Walmart and Starbucks who are dealing with the public to provide a few extra dollars per hour for their employees who are putting their lives on the line to make a living and serving the public. These couple of dollars along with only a couple of months according to these companies are characterized as hazard pay. These workers are providing the necessary and essential goods to the public such as food and supplies that get us through this crisis.

I watch the news everyday where ordinarily people who serve the public are classified as heroes. These people who work in the areas of fire fighters, truck drivers, law enforcement, shopping clerks, cashiers, nurses, in-home health aids, government officials, and the list goes on and on which their service is detrimental to support us through these hard times. The Soubra Law Firm is aware of this, and these people are who the Firm had served since its inception. This has been always the case.

The Firm main concern is to serve these everyday people in litigation to work for them. However, I am afraid for these people who are putting their lives on the line to serve the public. Today it is difficult enough just to make a living compounding with this disease pushing the people to the brink. However, you see how positive people can be during these tough trying times where they are singing and dancing on the streets to bring people spirits up.

If I Become Infected With the Coronavirus, can I Receive Workers’ Compensation Benefits?

You can receive workers compensation benefits for contracting the coronavirus from work which you must prove that it came from work. It is important that you do not get infected with the coronavirus. You must practice social distancing, hand washing frequently, wearing gloves, and wearing a face mask. However, many work places do not have access to gloves and face mask which will put an employee in a precarious and/or dangerous situation. What do you do? What must you do? You should exercise your best judgment. You should set an example for everyone. Please protect yourself. You are a mother, father, someone’s child, someone’s spouse, or you have loved ones who do not want to see you get infected with this disease. Make sure you do not touch your face. Have sanitizer available for you and use it frequently.

Have a Paper Trial When You Contracted the Coronavirus at Work

Be certain that you document all possible exposure of this coronavirus disease. You should report it to the manager or your immediate supervisor and make sure that you have the documents to prove it. You should have a copy of that document. Of course, based on my experience, employers and/or insurer will take the position that you did not contract the disease from work, but somewhere else. This is the position that employers/insurers normally take. Make sure that you document everything and be ready to fight for your legal rights to receive workers compensation benefits.

First of all, protect your health. Secondly, you should protect you and your family’s financial well-being. Document all instances that put yourself at risk. Now, if it is not documented, then the employer and/or insurer will say that it did not happen. Document the event weekly and submit them to your manager. You will say that I cannot do that because my manager think that I am crazy, but it is not being crazy, but being safe and healthy. Does being prudent and cautious equals crazy.

Should you have any questions with regards to your legal rights, you can contact the Soubra Law Firm at (301) 219-5038 or fill out a form providing us your information, so that we can contact you. We are open during these times where you need us the most.
